How Do I Prove Liability in a Dog Bite Case?

Dog bite cases are often difficult to prove because the victim is, by definition, an "invitee"—someone who is on another person's property with permission. The property owner is always responsible for keeping their premises reasonably safe, even if the invitee is a guest.

Under Ohio law, dog owners are liable for any damages their pets cause if:

  • The dog had a known history of violence or aggression and the owner did not take adequate steps to prevent the dog from harming others
  • The dog was not confined to the owner's property and the victim was lawfully on the property when the attack occurred
  • The dog was being used as a guard dog and the victim was trespassing

If the dog owner can prove that the victim was trespassing or otherwise unlawfully on their property at the time of the attack, they may not be liable for damages. However, a dog owner can never claim that their dog was "defending itself" if the victim was lawfully on the property.
